2. Hosting

The FoodScan legal pages are hosted by Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, United States, through the Vercel hosting platform available at vercel.com.

Hosting providers may process strictly necessary technical information, including connection logs and security-related metadata, for service delivery, infrastructure security, performance monitoring and abuse prevention.

3. Scope of Service

FoodScan is an informational mobile application designed to help users understand packaged food products by scanning barcodes and displaying product-related information, including ingredient data, nutritional indicators and processing-level information.

  • FoodScan is intended for informational and educational purposes only.
  • FoodScan does not provide medical advice, diagnosis, treatment, or personalised healthcare recommendations.
  • Users must always verify relevant information directly on the physical product packaging, especially in relation to allergens, intolerances, dietary restrictions, pregnancy, or medical conditions.

4. Intellectual Property

Unless otherwise stated, the FoodScan name, the FoodScan visual identity, original page designs, page layouts, source code, editorial text, database structures created by the operator, and all original elements of the application or website are protected by applicable intellectual property laws and remain reserved to their lawful owner.

No reproduction, republication, extraction, adaptation, translation, distribution, commercial exploitation or public communication of any substantial element of FoodScan may be carried out without prior written authorisation, except where such use is expressly permitted by mandatory law.

5. Third-Party Data Sources and Attribution

FoodScan may display product information obtained from the public Open Food Facts database. Open Food Facts is an independent collaborative database project and is not owned or operated by FoodScan.

FoodScan remains independent from Open Food Facts, Apple, food manufacturers, brands, distributors, and certification schemes, unless a specific written statement expressly provides otherwise.

6. Medical and Safety Limitation

FoodScan is not a medical device and is not intended to diagnose, treat, monitor, cure, or prevent disease. No score, badge, explanation, or summary presented in FoodScan should be interpreted as a clinical opinion or as a substitute for a physician, allergist, dietitian, pharmacist, or emergency professional.

  • FoodScan must not be relied on as the sole basis for medical, allergy, dietary, pregnancy-related, or treatment-related decisions.
  • Users should consult a qualified healthcare professional before making medical decisions.
  • In case of allergy risk, product recall, adverse reaction, or emergency, users must rely on the product label, the manufacturer, and appropriate medical or emergency services, not on the app alone.

While every effort is made to present clear, useful and good-faith information, FoodScan cannot guarantee that all data made available through third-party sources will be complete, current, accurate or suitable for every user situation.

  • Product composition, packaging, labels and formulations may change without notice.
  • Community-sourced databases may contain omissions, delays or inaccuracies.
  • FoodScan’s scoring, classification and explanatory content should be understood as informational indicators only.

To the fullest extent permitted by applicable law, FoodScan excludes liability for indirect, incidental or consequential loss arising from use of the service. Nothing in this Legal Notice excludes liability that cannot lawfully be excluded under applicable consumer protection or mandatory legal rules.

9. Applicable Law and Jurisdiction

This Legal Notice is governed by French law, subject to any mandatory consumer-protection provisions that may apply in the country of residence of an eligible consumer.

In the absence of amicable resolution, disputes involving non-consumer professionals shall fall within the jurisdiction of the competent courts of Lyon, France, unless mandatory law provides otherwise. Consumers retain the benefit of the jurisdiction rules and protections granted by applicable law.
